Privacy Protection

The Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) strikes a careful balance between the privacy rights of Canadians and the needs of law enforcement and national security agencies. The protection of privacy is a value that is an overarching fundamental consideration in every aspect of our operations. The PCMLTFA upholds the principles outlined in both the Canadian Charter of Rights and Freedoms and the Privacy Act, and it contains significant provisions specifically designed to protect the privacy of individuals.

In keeping with the Privacy Act and the PCMLTFA, FINTRAC routinely applies a high standard of privacy protection to the personal information under its control. A comprehensive set of practices, policies and procedures are in place for the protection of personal information. They include the application of the need-to-know principle, guiding principles for the handling of sensitive and classified information and diligent application of stringent measures surrounding the analysis and disclosure processes.

Requests submitted under the Privacy Act for access to personal information held by FINTRAC must be submitted in writing in the form of a letter, or through a Personal Information Request Form, which can be found in the Access to Information and Privacy section of the Treasury Board of Canada Secretariat Web site (www.tbs-sct.gc.ca). Please note that there are NO fees applicable to a privacy request.
